Social Security Disability Insurance

Social Security Disability Insurance (SSDI) is designed to replace income lost due to a serious and long-term medical condition, which prevents you from continuing to earn money from work. You are eligible for these benefits if you have paid a certain amount of Social Security tax over a period of time to have disability insurance coverage. As a general rule, this means you have worked and paid Social Security tax for at least the equivalent of five of the last ten years before you became disabled. How much you can expect to receive in benefits depends on how much you have paid into Social Security.

Proving Disability – Assuming you have met the tax contribution requirements, you must:

● Be unable to do any substantial work because of your physical or mental condition(s); and
● Your physical or mental condition(s) must last, or be expected to last at least 1 year or expected to end in death

The Application Process for receiving disability benefits can be difficult. The rules and regulations surrounding the Social Security system are complex, and people often underestimate the overwhelming amount of paperwork involved. Most people are initially denied and are forced to appeal the decision several times before being approved for Social Security Disability. This appeals process may take years to complete and can require the review and presentation of medical records and legal arguments to a judge to prove that your disability prevents you from working. Simply being diagnosed with a condition is not enough to prove disability for your claim.

Whether you are getting ready to file an initial application or you have already applied, been denied and seek to appeal the denial, working with an experienced Social Security Disability (SSD/SSI) attorney can greatly increase your chances for a successful claim or appeal, so call our office today.

NO ATTORNEYS FEES UNLESS YOU WIN – Since many people who apply for Social Security Disability are struggling with lost income, the cost of hiring an attorney can be a concern. We understand the financial constraints of our clients and offer our agreements based on a contingency, meaning you pay no attorney fees unless you win. Unlike many other firms, we do not charge set-up fees.

Gain Peace of Mind

Our goal is to create peace of mind for you and your family by resolving conflicts or by preventing them before they begin. Estate planning can be a difficult issue for many people to face, but it is a necessary process. Our comprehensive estate plans address important issues such as:

● Preserving your wealth during and after your lifetime
● Designating someone to manage your assets for your benefit should you be unable to do so
● Who will make your medical decisions if you are unable to do so
● Ensuring those you care about receive your property after your death
● Avoiding probate where possible by removing property from the probate estate
● Minimizing tax consequences

Probate is a very long and expensive process. It can take longer than a year and courts closely supervise probate so fees can accumulate quickly. Additionally, your probate estate is a matter of public record. Our comprehensive estate plans seek to avoid probate or to minimize the contents of the probate estate so that your loved ones receive property quickly, without having to wait for the probate process.

Our Orange County Estate Planning Attorneys understand that a comprehensive estate plan should do more than simply distribute your assets. A good estate plan can provide for your care should you become incapacitated and establish a continuing source of income for your loved ones after your death. We create comprehensive estate plans that are tailored to fit your needs using a variety of estate planning tools:

● Last Will and Testament
● Trusts [Revocable Living Trusts, Spendthrift Trust, Irrevocable Life Insurance Trust, Special Needs Trust] ● Powers of Attorney [Living Will, Durable Financial Powers of Attorney, Advance Health Care Directives] ● Specific final arrangements, such as whether to be buried or cremated, are also often part of the documents

Asylum: If you face persecution in your native country, seek shelter in California

What is Asylum? Asylum is an immigration status the can be claimed here in the U.S. by foreign nationals. Those seeking asylum are fearful of persecution in their country of origin and wish to escape the persecution by staying here in the U.S. Persecution means harm because of someone’s: 1) political beliefs, 2) gender, 3) sexual orientation, 4) ethnicity, 5) nationality, or any other “group” of people sharing a common identity. Individuals who fear torture, rape, imprisonment, death, marginalization–among many other situations–are considered acts of persecution if they are committed based on those five grounds..

Eligibility. To be eligible for asylum, you must prove that 1) you are unable to return to your country of origin because you have a well- founded fear of either past or future persecution; and that 2) your persecution is on account of your race, religion, nationality, membership in a particular social group, or your political opinion. These five grounds can be further broken down into sub-groups, such as sexual orientation, gender, and other minority groups.
